Education & Skills Funding Agency (ESFA)

Authority: Department for Education — manages apprenticeship funding, provider registration and financial controls

Registration & Legal Status

□

Registered on RoATP (Register of Apprenticeship Training Providers)

Active status on the public register — searchable at gov.uk/guidance/register-of-apprenticeship-training-providers. Must be renewed annually.

□

Valid Data Sharing Agreement (DSA) signed with ESFA

DSA gives ESFA permission to share learner data. Required before any funding can be drawn. Covers ILR, DAS and other data flows.

□

Financial health declaration submitted annually

Providers must pass ESFA financial health checks. Below minimum standard = funding suspended. Includes balance sheet, income and key ratios.

Delivery Obligations

□

Apprenticeship agreement signed with employer AND apprentice

Tripartite agreement (Employer–Provider–Apprentice). Must be signed before training starts. Defines employer obligations, hours, pay and training plan.

□

Commitment statement signed within 6 weeks of programme start

Sets out training plan, OTJ schedule, review dates and EPA arrangements. Must reflect the apprenticeship standard. Revised if circumstances change.

□

Off-the-job training (OTJ) ≥20% of paid hours — logged and evidenced

Must occur during normal working hours. Cannot include end-point assessment or initial assessment. Must be tracked and verifiable on audit. Common audit failure point.

□

Progress reviews conducted every ≤12 weeks (3-way: provider, employer, apprentice)

Reviews assess progress against KSBs, OTJ hours, English/maths, welfare. Must be recorded in an agreed format. Employer representative must be present or confirm by written sign-off.

□

English and maths requirements met or on programme

Level 2 English and maths required for Level 3+ apprenticeships. Functional skills or GCSE C/4+ acceptable. Provider must fund and deliver if not already held.

□

End-Point Assessment Organisation (EPAO) contracted

EPAO must be registered on the IfATE EPAO register for the relevant standard. Provider cannot self-assess. Contract must be in place before gateway.

□

Prior learning recognised and funding adjusted accordingly

Recognition of Prior Learning (RPL) must shorten the programme where appropriate. Misuse of prior learning to inflate funding is a key compliance risk.

Financial & Reporting

□

ILR (Individualised Learner Record) submitted accurately on schedule

ILR submitted to ESFA each term via HESA or Collect. Field-level accuracy drives payment calculations. Errors trigger clawback. Must use correct completion status codes (1=continuing, 2=completed, 3=withdrawn).

□

Subcontracting register published publicly (if applicable)

Required if subcontracting >£100,000. Must name subcontractors, value, delivery type and oversight arrangements. Due diligence on subcontractors must be evidenced.

□

Non-levy employer co-investment (5%) collected and declared

Non-levy employers contribute 5% of training cost. Provider cannot waive this — constitutes fraud. Must be shown on invoices and reconciled monthly.

□

Maximum contract value not exceeded without prior ESFA approval

ESFA sets an earnings threshold for each provider. Exceeding without approval triggers a funding agreement breach. Large providers require separate contracted limits.

□

Audit-ready documentation maintained for minimum 6 years

All learner files, ILPs, review records, OTJ logs, English/maths evidence, gateway paperwork. ESFA or its agents may audit at any time with limited notice.
